Recently, the General Office of the State Council promulgated the Government Enterprise Information Collection and Aggregation Plan. The Plan clarifies that all government enterprises’ information scattered in various departments shall be collected, aggregated and made public in the National Enterprise Credit Public Information System.
Promoting public accessibility to aggregated government enterprise information will facilitate a broader number of consumers and market transaction objects in having readily available information on administrative licensing, administrative penalties and the operating states of various enterprises across the whole country. Furthermore, the benefits of this public work include reducing the risks and costs of transaction, granting clarity to businesses and industry associations on current market conditions, the efficient allocation of resources and strengthening the coordination and regulation of government departments. Stronger oversight will be exercised over delegated matters while they are being processed and after as well.
The Plan makes it clear that any information collected on government enterprises, should be done so in accordance with the applicable laws, including enterprise registration records, chattel mortgage registration, equity pledge registrations, intellectual property rights pledge registration, trademark registration, administrative licensing, administrative penalty, as well as be included on the list of abnormal operation and the more serious illegal enterprise list (“black list”) where necessary. Selective examination results, etc., and other enterprise information should also be provided within the letter of the law.
The Plan proposed to adhere to the basic principles of unified collection, acting in accordance with the laws. In accordance with the “Keeping the providers responsible” requirement, the government shall establish an efficient and smooth system with integrity, clearly defined responsibilities, and effective supervision regarding information collection. All localities and departments shall put all information produced into the National Enterprise Public Credit System accurately and in a timely manner. The information will be recorded under the name of the relevant enterprise and then made public within 20 working days.
The Plan stresses that each provincial government, shall bear overall responsibility for its administrative region’s enterprise information collection work, shall construct an enterprise credit information publicity system within their respective administrative areas according to the general requirements of the national social credit platform construction and the Plan. Based on the existing conditions, government departments at all levels shall collect and classify enterprise information in accordance with the Plan. Industry and commerce departments shall do an adequate job of constructing the enterprise credit information publicity system as well as completing other work involved in the coordination of relevant services and technical support. The State Administration of Industry and Commerce (SAIC) shall be responsible for formulating the release of The Government Department Enterprises’ Information Collection Format Specifications and regular releases of The Catalog of Government Department Enterprise Information Collection Resources.
The Plan proposes to expand the application of the collected enterprise information in the public service field, open information resources, optimize related services, encourage all sectors of society to use public data to collaborate, and promote the development of market-oriented credit services.
