Intelligent examination improves quality and efficiency of TM review cases

The Trademark Review and Adjudication Division (the former TRAB) of the China National IP Administration (CNIPA) was active in improving the quality and efficiency of examining trademark review cases, and in the first half of 2020, concluded 190K trademark review cases, an increase of 22.56% over the same period of last year. The Division accepted a total of 448 administrative re-examination cases, an increase of 2.52% over the same period of last year, and concluded 559 re-examination cases, an increase of 64.9% over the same period of last year.

While combating the covid-19 pandemic, the Division worked hard on intelligent examination of review cases and provided more convenient services to the relevant parties, which was highly commented.

In order to actively safeguard the applicants’ lawful rights and interests, the Division initiated the “cloud review” mode and heard some trademark invalidation cases including an oral hearing relating to a foreign party.

The Division has been working hard in the direction of fully electronic review. On July 28, appeal against trademark rejection could be filed on-line. Within this year, the CNIPA will open the online filing of trademark invalidation, opposition and three-year non-use cancellation.

The relevant parties and practitioners will benefit more and more from the CNIPA’s regularly improving online services in a more cost-efficient manner.
